Access to and use of the Access Accelerated Open Platform at aaopenplatform.org ("Platform") and the information, materials, products and services available through the Platform are subject to these terms of use (“Platform Terms of Use”).

The Platform Terms of Use may be updated from time to time. Updated versions will be posted on the Platform and are effective immediately. When using the Platform you should regularly verify whether the Platform Terms of Use have been updated or amended.

The Platform provides information on the Platform itself and contains datasets collected from open data sources like Access Observatory, WHO, World Bank, UNstat of data and Access Accelerated Member websites (“Datasets”). Access to these Datasets is provided free of charge subject to these Platform Terms of Use and the general Terms and Conditions [include link]. Use of data derived from the Datasets, which may appear in formats such as tables and charts, maps and other visuals is also subject to these Dataset Terms.

II. Use of Platform Materials

The “Access Accelerated” name and logo are protected by intellectual property rights, including copyrights, trade names and trademarks, and are owned by Access Accelerated or used by Access Accelerated under a license or with permission from the owner of such rights. Materials protected by such intellectual property rights include the design, layout, look and appearance on the Platform (collectively, “Platform Materials”).

Platform Materials may only be reproduced, distributed, published or otherwise publicly presented based on a prior explicit written permission from Access Accelerated. III. Use of Datasets Made Available on the Platform

The Datasets collected from different sources and provided on the Access Accelerated website are provided under a Creative Commons Attribution 4.0 International License (CC BY 4.0). When you download or use the Datasets, you are agreeing to comply with the terms of a CC BY 4.0 license which you may access at https://creativecommons.org/licenses/by/4.0/legalcode

This means, for instance, that you agree to include relevant references to the data source and to the fact you modified the data. When sharing, or facilitating access to the Datasets, you agree to include the same acknowledgment requirement in any sub-licenses of the data that you grant, and a requirement that any sub-licensees do the same.

IV. No Endorsement

You may not publicly represent or imply that Access Accelerated is participating in, or has sponsored, approved or endorsed the manner or purpose of your use or reproduction of the Datasets.

V. Website Privacy and Cookie Notice

All personal data provided to Access Accelerated while using the Access Accelerated Platform will be handled in accordance with the Access Accelerated Website Privacy/Cookie Notice.

We may link to other websites which are not within our control. We are not responsible or liable for the information or materials made available by such third party websites. We encourage you to read the terms of use and privacy statements of all third party websites before using such websites or submitting any personal data or any other information on or through such websites.

VII. Links from Other Websites to our Platform

VIII. No Warranties

Access accelerated reserves the right at any time to modify or discontinue, temporarily or permanently, this Platform, the Datasets, any means of accessing or utilizing the Datasets, at our sole discretion with or without prior notice to you.

Access Accelerated disclaims liability of any kind related to the provision and accuracy of the Datasets.

IX. Exclusion of Liability

To the extent permitted by applicable law, neither Access Accelerated nor its Partners or Members shall be liable for any direct, indirect, consequential or other damages whatsoever, including but not limited to property damage, loss of use, loss of business, economic loss, loss of data or loss of profits, arising out of or in connection with your use or access to, or inability to use or access the Platform or its content, including the Datasets.

We will use reasonable efforts to ensure that the information and materials provided on this Platform are correct. However, we cannot guarantee the accuracy of all information and materials and do not assume any responsibility or liability for the accuracy, completeness or authenticity of any information and materials contained on this Platform. We do not warrant that the operation of this Platform will be uninterrupted or error-free, or that this Platform is free from viruses or other components that may be harmful to equipment or software. In case of a violation of these Platform Terms of Use, particularly in case of use of the Platform or individual elements of the Platform for other than its intended use, access to the Platform may be restricted or blocked.

Access Accelerated generally reserves the right to partially or entirely alter, block, or discontinue the Platform or its content at any time and for any reason.

XI. Severability Clause

Should one of the provisions of these Platform Terms of Use be invalid or declared invalid by a court, this will not affect the validity of the remaining terms.

XII. Choice of Law, Jurisdiction and Venue

The use of the Platform and these Platform Terms of Use are governed by Swiss Law. Unless otherwise provided by law, the competent court in the canton of Geneva, Switzerland has exclusive jurisdiction over any disputes arising from or in connection with the use of the Platform or these Platform Terms of Use.
